1Acceptance of Terms

These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the website mymocktest.com, the mymocktest mobile application, and all related services, content, features, tools, and products offered through them (collectively, the "Platform" or "Services").

By creating an account, accessing the Platform, browsing any page, downloading the mobile application, purchasing a subscription, or otherwise using any feature of the Services in any manner, you confirm that you have read, understood, and unconditionally accept these Terms, our Privacy Policy, our Refund Policy, and any other policies referenced herein, which are incorporated by reference into this Agreement.

If you are accepting these Terms on behalf of a coaching institute, educational organisation, or any other entity, you represent and warrant that you have the authority to bind such entity to these Terms.

2Definitions

In these Terms, unless the context requires otherwise:

• "Platform" means the mymocktest website, mobile applications, and all associated services.
• "User", "you", "your" means any individual or entity that accesses or uses the Platform.
• "Account" means the registered profile created by the User on the Platform.
• "Content" means all questions, mock tests, study materials, explanations, analytics, text, images, audio, video, and any other material made available on the Platform.
• "Subscription" means any paid plan, pass, package, or product purchased by the User to access premium features of the Platform.
• "Mock Test" means a simulated examination, section test, topic-wise quiz, previous year paper, or any practice test offered through the Platform.
• "Applicable Law" means all statutes, rules, regulations, notifications, circulars, orders, judgments, and any other binding legal instruments applicable in India.

3Eligibility

The Platform is available for use by individuals who are at least 13 (thirteen) years of age. Users below the age of 18 are considered minors under the Indian Contract Act, 1872, and may use the Platform only under the supervision of a parent or legal guardian who agrees to be bound by these Terms on their behalf.

By using the Platform, you represent and warrant that:

• You meet the minimum age requirement specified above;
• You possess the legal capacity to enter into a binding contract under Applicable Law;
• You are not a person barred from receiving services under the laws of India or any other applicable jurisdiction;
• All information provided by you during registration and use of the Platform is true, accurate, complete, and current.

We reserve the right to refuse Service, terminate Accounts, or deny access to any User at our sole discretion, without notice, if any of the foregoing representations are found to be untrue.

4Account Registration

To access certain features of the Platform, including paid Mock Tests and analytics, you must register and create an Account. During registration, you may be required to provide your name, mobile number, email address, target examination, and other relevant information.

4.1 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials, including username, password, and any one-time passwords (OTP). You agree that any activity that occurs under your Account, whether or not authorised by you, shall be deemed to have been performed by you. You shall promptly notify us at support@mymocktest.com upon becoming aware of any unauthorised use of your Account or any other breach of security.

4.2 One Account per User

Each User is permitted to maintain only one Account on the Platform. Creation of multiple Accounts by the same individual, sharing of Account credentials, simultaneous logins from multiple devices in violation of subscription terms, or any attempt to circumvent device or session restrictions shall be considered a material breach of these Terms and may result in immediate suspension or termination of all such Accounts without refund.

4.3 Accuracy of Information

You agree to keep your Account information accurate, current, and complete at all times. You may update your information through the Account settings section of the Platform. We are not responsible for any consequences arising from incorrect, outdated, or incomplete information furnished by you.

5Description of Services

mymocktest is an online examination preparation platform designed for aspirants of competitive examinations conducted in India. The Platform offers, among other things:

• Full-length mock tests simulating the pattern of various examinations including but not limited to SSC CGL, SSC CHSL, SSC Stenographer, HSSC, RSMSSB, Banking (IBPS, SBI), State Public Service Commission examinations, and other competitive examinations;
• Section tests and topic-wise quizzes for focused practice;
• Previous year question papers ("PYQs") and pattern-based test sets;
• Detailed performance analytics, including score trends, topic-wise accuracy, time-per-question analysis, percentile rank, and improvement plans;
• Step-by-step solutions, explanations, shortcuts, and revision tools;
• Bookmarks, saved questions, and personalised revision lists.

The features available may vary based on your subscription type, the examination selected, the device used, and ongoing updates to the Platform. We continually evolve and improve our Services and reserve the right to add, modify, suspend, or discontinue any feature, content, or functionality at any time without prior notice.

6Subscriptions, Pricing & Payments

6.1 Free and Paid Services

Certain portions of the Platform are available free of charge. Access to premium features, including unlimited mock tests, advanced analytics, PYQs, and exam-specific practice sets, requires the purchase of a Subscription.

6.2 Pricing

All prices are displayed in Indian Rupees (INR / ₹) and are inclusive of applicable taxes unless stated otherwise. We reserve the right to revise pricing, introduce new plans, or modify existing ones at our discretion. Any change in pricing shall not affect Subscriptions already purchased and active at the time of such change.

6.3 Payment Processing

Payments on the Platform are processed through third-party payment gateway service providers, including but not limited to Razorpay, Cashfree, or similar PCI-DSS compliant providers. By making a payment, you authorise us and the payment gateway to charge the amount due using your selected payment method. We do not store your card details, banking credentials, or UPI PINs on our servers.

6.4 Activation of Subscription

Subscription benefits shall be activated on your Account immediately upon successful confirmation of payment from the payment gateway. In the rare event of a delay due to technical or banking reasons, you may contact support@mymocktest.com with the transaction reference.

6.5 Validity and Auto-Renewal

Each Subscription has a defined validity period as displayed at the time of purchase. Unless explicitly stated otherwise at the time of purchase, Subscriptions do not auto-renew. You will need to purchase a fresh Subscription upon expiry to continue accessing premium features.

6.6 Refunds

All payments are final and non-refundable except in limited circumstances as detailed in our Refund Policy, which forms an integral part of these Terms.

7Content & Intellectual Property

All Content available on the Platform, including but not limited to question banks, mock tests, solutions, explanations, study notes, illustrations, graphics, audio recordings, video lectures, logos, brand names, trademarks, software code, user interface designs, layouts, and the compilation thereof, is the exclusive property of mymocktest or our licensors, and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other Applicable Laws relating to intellectual property.

The "mymocktest" name, logo, taglines, and other distinctive brand elements are our trademarks. You shall not use, copy, imitate, or display these marks without our prior written permission.

Questions and content may be inspired by, derived from, or modelled on the pattern of various public examinations. However, the curation, presentation, sequencing, analytics methodology, and explanation style are proprietary to mymocktest.

8License to Use

Subject to your continued compliance with these Terms and the payment of applicable Subscription fees (where required), we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform and the Content strictly for your personal, non-commercial examination preparation purposes.

You shall not, without our express prior written consent:

• Reproduce, duplicate, copy, sell, resell, redistribute, sublicense, lease, or otherwise commercially exploit any portion of the Platform or Content;
• Take screenshots, screen recordings, photographs, or any other form of capture of questions, solutions, or other Content with the intent of distribution, public display, or unauthorised use;
• Use any automated system, including but not limited to "robots", "spiders", scrapers, or offline readers, to access the Platform;
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Platform or any associated software;
• Use the Content to create derivative works, including question banks, coaching materials, YouTube content, or similar products that compete with or replicate the Platform.

Any unauthorised use of the Platform or Content shall immediately terminate the license granted under this clause and may give rise to claims for damages, injunctive relief, and criminal prosecution under Applicable Law.

9User Conduct

You agree to use the Platform in good faith and in accordance with these Terms, all Applicable Laws, and generally accepted standards of online conduct. While using the Platform, you shall:

• Attempt mock tests fairly, without resorting to unfair means, browser exploits, or external assistance designed to artificially inflate your performance;
• Provide truthful information in your profile and during all interactions with us;
• Respect other Users, our staff, and our community;
• Promptly report any bugs, vulnerabilities, or suspected misuse to support@mymocktest.com.

10Prohibited Activities

You shall not, directly or indirectly, engage in any of the following activities:

• Content theft: Sharing, distributing, uploading, or selling Platform Content on any third-party platform, including but not limited to Telegram channels, WhatsApp groups, YouTube, Instagram, Facebook, file-sharing services, or competing websites;
• Account sharing: Sharing your Account credentials with other individuals, allowing multiple persons to use a single Account, or selling/transferring Account access;
• Cheating mechanisms: Using any software, plugin, extension, or device that interferes with the normal functioning of mock tests, manipulates timers, alters scores, or provides external answers during a test;
• Unlawful conduct: Using the Platform for any unlawful, fraudulent, defamatory, obscene, harassing, abusive, threatening, or harmful purpose;
• Impersonation: Posing as another person, including any employee, officer, or representative of mymocktest, or misrepresenting your affiliation with any individual or entity;
• Security violations: Attempting to gain unauthorised access to any portion of the Platform, related systems, networks, accounts, servers, or computers; introducing viruses, worms, trojans, or any malicious code; or otherwise compromising the security of the Platform;
• Disruption: Interfering with or disrupting the integrity or performance of the Platform, conducting denial-of-service attacks, or transmitting any spam, junk mail, or unsolicited communications through or to the Platform;
• Misrepresentation: Posting false reviews, manipulating rankings, or otherwise manipulating analytics data;
• Violation of rights: Infringing any intellectual property, privacy, publicity, or other proprietary rights of any third party or of mymocktest.

Any violation of this clause may, at our sole discretion, result in immediate suspension or permanent termination of your Account without any refund of subscription fees, in addition to such other legal remedies as may be available to us under Applicable Law.

11Content Accuracy Disclaimer

While we make sincere and reasonable efforts to ensure the accuracy, currency, and quality of the Content available on the Platform, mymocktest does not warrant or guarantee that:

• The Content is free from errors, omissions, or typographical mistakes;
• The Content fully reflects the latest examination pattern, syllabus, or notification of any examining authority;
• The Mock Tests are an exact replica of any official examination conducted by any government body or examining authority;
• Use of the Platform will result in selection or qualification in any examination or guarantee a particular rank, percentile, or score.

The Platform is an aid for examination preparation. It does not replace official sources, notifications, syllabi, or examination materials published by the respective examining authorities. Users are strongly advised to refer to official sources for authoritative information regarding any examination.

If you notice any inaccuracy or error in the Content, please report it to support@mymocktest.com so that we can review and correct it.

12Third-Party Services & Links

The Platform may contain links to third-party websites, services, or applications that are not owned or controlled by mymocktest. We have no control over the content, privacy policies, or practices of any third-party site or service. We shall not be responsible or liable for the availability, accuracy, content, products, or services of such third parties.

Your use of any third-party service, including payment gateways, communication services, and authentication providers, shall be subject to the terms and policies of the respective third party. We strongly recommend that you review the terms and privacy policies of any third-party service before using it.

13Suspension & Termination

We may, at our sole discretion and without notice or liability to you, suspend, restrict, or terminate your Account and access to the Platform, in whole or in part, for any reason, including but not limited to:

• Breach of these Terms or any policy referenced herein;
• Engagement in any Prohibited Activity (Clause 10);
• Suspected fraudulent, unlawful, or malicious activity;
• Non-payment, chargeback, or payment dispute initiated by you;
• Requirement by a court, regulatory authority, or other competent body;
• Cessation, in whole or in part, of the Platform.

Upon termination of your Account, your right to access the Platform and Content shall cease immediately. Any data, performance history, bookmarks, or saved content associated with your Account may be deleted in accordance with our data retention policies, and no claim shall lie against mymocktest for such deletion.

You may terminate your Account at any time by writing to support@mymocktest.com. Termination by you does not entitle you to any refund of any Subscription fees previously paid.

14Disclaimer of Warranties

The Platform and all Content, products, and services are provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted availability.

Without limiting the foregoing, we do not warrant that:

• The Platform will be available at all times, without interruption, or be free from errors, defects, or bugs;
• The Platform, its servers, or any communications sent from us are free from viruses or other harmful components;
• The results obtained from use of the Platform will meet your expectations;
• Any specific examination outcome, rank, score, or selection will result from use of the Platform.

15Limitation of Liability

To the maximum extent permitted by Applicable Law, in no event shall mymocktest, its founders, directors, employees, agents, affiliates, partners, or licensors be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation damages for loss of profits, loss of revenue, loss of data, loss of opportunity, loss of business, loss of goodwill, or other intangible losses, arising out of or in connection with:

• Your access to, use of, or inability to access or use the Platform;
• Any failure or interruption in the availability of the Platform;
• Any errors, omissions, inaccuracies, or defects in any Content;
• Any examination outcome, ranking, or selection (or absence thereof) connected in any manner to use of the Platform;
• Any unauthorised access to or alteration of your transmissions or data;
• Any conduct or content of any third party on the Platform.

Notwithstanding anything to the contrary in these Terms, the maximum aggregate liability of mymocktest to you in respect of any and all claims arising out of or relating to these Terms or the use of the Platform shall not exceed the total amount actually paid by you to mymocktest in the three (3) months immediately preceding the event giving rise to such liability, or INR 1,000, whichever is lower.

16Indemnification

You agree to defend, indemnify, and hold harmless mymocktest, its founders, directors, employees, agents, affiliates, partners, and licensors from and against any and all claims, demands, suits, proceedings, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your breach of these Terms or any policy incorporated herein;
• Your violation of any Applicable Law or any rights of any third party;
• Your use or misuse of the Platform or Content;
• Any false or misleading information provided by you.

17Force Majeure

mymocktest shall not be liable for any failure or delay in performance of its obligations under these Terms to the extent such failure or delay is caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, earthquake, pandemic, epidemic, war, riot, civil unrest, terrorism, government action, change in law, internet outages, telecommunications failures, electricity failures, denial-of-service attacks, third-party service failures (including payment gateways and cloud service providers), or other similar events ("Force Majeure Event"). The performance of such obligations shall be suspended for the duration of the Force Majeure Event.

18Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions.

Subject to Clause 19 (Dispute Resolution), the courts at Jaipur, Rajasthan, India shall have exclusive jurisdiction over any dispute, controversy, or claim arising out of or in connection with these Terms or the Platform.

19Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or in connection with these Terms, including the existence, validity, interpretation, performance, breach, or termination thereof:

1. Amicable resolution: The Parties shall first attempt to resolve the dispute amicably through good-faith discussions. The aggrieved Party shall send a written notice of dispute to the other Party at the contact details mentioned in Clause 22.
2. Arbitration: If the dispute is not resolved within 30 (thirty) days of the written notice, the dispute shall be finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mymocktest. The seat and venue of arbitration shall be Jaipur, Rajasthan, India. The language of arbitration shall be English. The award of the arbitrator shall be final and binding on the Parties.

20Changes to Terms

We reserve the right to modify, amend, update, or replace these Terms at any time, at our sole discretion. The updated Terms shall be posted on this page with a revised "Last updated" date. Material changes shall, where practicable, be notified to registered Users via email or in-Platform notification.

Your continued use of the Platform after the effective date of the updated Terms shall constitute your acceptance of the updated Terms. If you do not agree with the updated Terms, you must discontinue use of the Platform.

21Severability, Waiver & Entire Agreement

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

Waiver: No failure or delay by us in exercising any right or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right preclude any other or further exercise of such right.

Entire agreement: These Terms, together with the Privacy Policy, Refund Policy, and any other policies referenced herein, constitute the entire agreement between you and mymocktest concerning the Platform and supersede all prior or contemporaneous understandings, communications, or agreements.

Assignment: You shall not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms without restriction.

For any questions, concerns, complaints, or grievances regarding these Terms or the Platform, please contact us using the details below.

The Grievance Officer shall acknowledge complaints within 24 (twenty-four) hours of receipt and shall endeavour to redress the same within 15 (fifteen) days of receipt, in accordance with Applicable Law.
